Few parts of the rental relationship cause more friction than the security deposit. When a tenant moves out expecting a full refund and instead receives a fraction of it, disputes — and sometimes lawsuits — follow. The good news for Tampa landlords is that Florida law is fairly clear about what you can and cannot deduct, and following the rules closely is the single best way to protect yourself.

## Normal wear and tear vs. actual damage

The most important distinction in any deposit dispute is the line between normal wear and tear and tenant-caused damage. Wear and tear is the natural decline a property experiences from ordinary, everyday living — and you cannot charge a tenant for it.

Damage, on the other hand, is harm beyond ordinary use, whether from negligence, misuse, or neglect. That is fair game for a deduction, provided you can document it.

-   Wear and tear (not deductible): faded paint, minor carpet wear in walkways, small nail holes, lightly worn fixtures.
-   Damage (deductible): large holes in walls, pet stains and odors, broken appliances, missing fixtures, excessive filth requiring professional cleaning.

## Florida's notice rules are strict

Florida sets specific timelines for handling deposits, and missing them can cost you the right to keep any portion of the funds. If you intend to make no deductions, you generally must return the deposit within 15 days of the tenant moving out.

If you intend to claim against the deposit, you must send written notice by certified mail within 30 days, stating your intent and the amount. The tenant then has 15 days to object. Skipping or fumbling this notice is the fastest way to lose a deposit dispute.

## Documentation is everything

When a deduction is challenged, the landlord who wins is almost always the one with the better paper trail. Detailed move-in and move-out inspections — supported by dated, time-stamped photos — turn a he-said-she-said argument into a clear factual record.

Keep receipts and invoices for every repair you charge against a deposit. A vague "cleaning fee" invites a challenge; an itemized invoice from a vendor does not.
